11. Dispute Resolution & Arbitration
At Everyday AlphaGal LLC, we aim to resolve concerns quickly and respectfully. If any claim or dispute arises out of or relates to your use of this website or these Terms of Use, you agree to the following resolution process:
A. Informal Resolution:
You agree to contact us first at admin@everydayalphagal.com to attempt to resolve the issue informally through good-faith communication. Both parties agree to allow up to thirty (30) days for such informal resolution.
B. Mediation :
If the dispute is not resolved informally, both parties may voluntarily agree to engage in non-binding mediation, conducted by a neutral third party, before proceeding to arbitration.
C. Binding Arbitration:
If informal resolution (and mediation, if elected) fails, you agree that the dispute shall be submitted to final and binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration service.
The arbitration shall take place in McNairy County, Tennessee, unless both parties agree otherwise in writing. The party initiating arbitration shall bear all filing and administrative costs, unless the arbitrator determines another allocation of costs is appropriate.
D. Waiver of Class Actions & Jury Trial:
You agree to waive any right to a jury trial or to participate in a class, collective, or representative proceeding. Arbitration shall be conducted solely on an individual basis.
E. Small Claims Court Exception:
Notwithstanding the above, either party may bring an eligible claim in small claims court in McNairy County, Tennessee, provided the claim remains solely within that court’s jurisdiction and does not seek injunctive relief or class-wide remedies.
This dispute resolution agreement survives the termination of these Terms and your use of the website.
